Constitutional Law
Constitutional Law is the regulated set of rules, norms and regulations governed by a body of law that interprets and implements the policies stated in the United States Constitution. The constitutional authority of the Supreme Court requires vigorous implementation as it runs and regulates the society besides maintaining relationship between federal and state government. Application of terms of constitution also monitors rights of individual citizens and fundamental aspects of government authority. The power of judicial review is vested with the Supreme Court of United States based on Article III which is assigned to face obstacles and challenges to the implementation of constitutional authorities in federal and state government.
The decision of court to strike down laws that are obligation to the constitution had been done with clauses such as Contract Clause, Equal Protection Clause and Commerce Clause. The way by which the Supreme Court interprets the constitutional law binds the executive and legislative branches of the federal government besides governing its lower hierarchy courts. Decisions made by court are based on several factors such as actual dispute, standing, ripeness, mootness and political question. Unless a query arises in application of going against the norms, the court has the firm authority to implement and declare a judgment if no political question arises.
Constitutional Law is the collective norms for governance but applying it in practical society varies based on federal, state or local government. Governing all of them together are the Supreme Courts and their exercised power ensures unbiased implementation of constitutional laws while it is the duty of judges based on their experience and ideologies. Interpretation styles are not similar as it could be categorized as originalists, judicial restraint and judicial activism. Constitution appears static yet it is the viewpoint of a justice who decides or detests in changing its ways for the social betterment that led to such improved democratic application.
Modern day constitution was formed by Benjamin Franklin with many other leaders which are in existence today. Wilson was another theorist of the era and together these erudite people laid stone for the democratic republic by questioning the superiority of government which was designed to serve people and not dominate them in any way. From founding to civil war, reconstruction, new deal are part of constitutional developments which also overlooks spending power of citizens for printing money, control immigrants, govern copyrights and patents besides making constitutional amendments for society.
