Divorce Law

Divorce law in each country differs according to the constitution and rights established by the states which are often made in correspondence or relevance to the local customs, traditions and religious faith. It is generally said that marriages are made in heaven but in reality it doesn’t seem to be happening and people are responsible for marriages to happen and breaking the same agreement. That is the reason why people advice counseling for one or both the couples when things are not going their way.

Based on religious precepts

Marriage, Divorce, Custody and Maintenance are largely governed by the religion practiced by the parties to the marriage. If both parties belong to the same religion, the marriages are conducted by the church (in case of Christianity) arranged by the parents both the bride and the bridegroom. As well they have rules and precepts of the religion to which the married couples are bound. Often misunderstanding and disputes in the marriages are rectified by the spiritual guide or the priest in the concerned parish. Only when the church is not able, though not recommended the couple seek the assistance of the court for divorce.

Approaching elders for solutions

Likewise in other religions too they have their own rules and regulations for marriage and divorce. And people are supposed to approach the elders of the respective religions to seek counsel before they approach court or bound by state laws and legal environment. For instance in Islamic tradition uttering the word “thalaq” thrice by men in front of the elders will mean the person has divorced his spouse. At the same time the woman have no such rights to divorce her husband is negative aspect or inequality.

Courts to solve the problem

To divorce the husband or the wife in any court, the applicant cast to offer the court with suitable reason and supporting the cause he/she has to produce evidence. Usually for divorces if both the spouses are willing break from the bond then it is much easier. But if one who is applying wants to be divorced from his wife or her husband then certain complications are there for the court to announce the couples as divorced.

So it is followed by compensations to the other, particularly by men and in rare cases even women to men certain amount and property is settled to support him/her. This is the opportunity or the benefits of the law everywhere considering the person’s inability and the future. Thus divorce law transforms to time and locations and people but sad part is most of the cases coming to court today are divorce cases.
