What are Negotiable instruments?

For every transaction we do there will be a buyer and a seller, and the cash or check will be interchanged for the product. Well in this case we are not talking about your negotiable skills with the buyer.

The Negotiable instruments include the following items:

  • Draft
  • Checks
  • Certificate for depositing
  • Notes

The drafts and checks come under the category of a promise made to be paid while notes are promises made by one person to other to pay the money back anytime the lender asks for it. Certificate for depositing refers to the note you get when you deposit your money in the bank, the bank agrees to pay you a rate of interest over a period of time. 

Some of the factors that are to be considered before an instrument can be negotiated

  • It should be clearly written
  • The amount involved in the transaction should be mentioned properly
  • The date of payment should be mentioned clearly

The liability associated with Negotiable instruments includes:

  • Signature liability
  • Warranty liability

Signature liability insists that once you have made a contract to pay back the money on a certain date, than the contract has to be thoroughly followed. By not following the agreements of your contract you will be getting yourself to more trouble. Warranty liability also consists of two type’s transfer of liability and presentment liability. So it is always advisable that you research in full detail and consider the option that is better suited to your situation. In this way the tension and stress will be considerably less for you.
