Antitrust

Meaning:

Anti -trust laws refers to the legislation being enacted by the federal and state governments with a view to regulate trade and commerce activities by prohibiting unlawful self possession, price-fixing, and monopolies, to encourage competition, and to stimulate the production of quality goods and services at nominal prices, with the primary objective of safeguarding public interest by ensuring that consumer demands will be taken care of by the manufacture and sale of goods at reasonable prices. The antitrust laws in the United States are stringent and more comprehensive when compared to other industrialized nations. Many other industrialized nations, focus on the possibility of foreign competition and as a result have minimal antitrust law. In the United States, the original antitrust law was the Sherman Act of 1890, with important extensions added in 1914.

Objectives:

Antitrust law ensures fair business practices and thus the public interest is safeguarded. It has had a highly positive impact on business practices and the organization of U.S. industry. It has been formulated on the premise that free trade is of greater benefit to the economy, businesses and the consumers. The law prohibits several types of restraint of trade and monopolization.

Enforcement:

Enforcement of antitrust law to a greater extent depends on two agencies, namely the Federal Trade Commission (FTC), which may cessation issue orders to violators and the U.S. Department of Justice's Antitrust Division, which can litigate. Private parties may also report civil issues. The amount of penalty may extend extend to $350,000 and an imprisonment upto 3 years. The federal government, and individuals together gather the amount of damages which have resulted from injuries.

Discovery of Violations:

Since bid rigging and price fixing schemes are bound to involve a lot of conspiracies, the companies involved in such corrupt practices try to cover it up. The Justice Department is dependent on reports from consumers and competitors for information regarding violation of anti- trust rules. According to the Antitrust Division, a major junk of all federal investigations results from complaints which are usually made by the consumers or businessmen by emails, phone or sometimes even by person.
